California’s Security Deposit Law: What AB 2801 Means for Landlords

What Does AB 2801 Require?

Under AB 2801, if a landlord makes any deductions from a tenant’s security deposit (for cleaning, repairs, or unpaid rent), they must now include photo or video evidence of the issue, along with the itemized statement of deductions.

Key Provisions:

  • Applies to all residential leases in California
  • The itemized statement must include:
    • A description of the issue
    • The cost of repair or cleaning
    • Photographic or video proof
  • All documentation must be provided within 21 days of the tenant vacating (in line with existing security depositlaw per California Civil Code §1950.5)

Why the security deposit Law Was Passed

AB 2801 was introduced to:

  • Promote transparency in deposit return practices
  • Protect tenants from unsubstantiated deductions
  • Encourage better documentation and communication

According to the California Department of Consumer Affairs, disputes over security deposits are among the most common legal conflicts between landlords and tenants. AB 2801 is designed to reduce these conflicts by requiring visual proof of claimed damages and revising security deposit law.

What Landlords and Property Managers Need to Do Now

Before Move-In:

  • Conduct a detailed move-in inspection with the tenant
  • Take time-stamped photos or videos of the unit’s condition
  • Use a written checklist signed by the tenant to acknowledge the initial state

During Move-Out:

  • Offer a pre-move-out inspection (as required under Civil Code §1950.5(f)) to allow tenants time to address issues
  • After the unit is vacated, document damages thoroughly with new photos or videos
  • Match each deduction in your itemized list with corresponding visual proof

Within 21 Days of Move-Out:

  • Provide the tenant with:
    • A clear itemized list of deductions
    • Receipts or repair estimates

Photo or video evidence for each item deducted. The 21 day timeline is not new for security deposit law, but the items the must be provided has become much more detailed. 

Consequences of Non-Compliance

If you fail to follow the requirements of AB 2801, you may:

  • Lose the right to withhold funds from the security deposit
  • Face small claims lawsuits or legal penalties
  • Suffer reputational damage as a landlord or management firm

In cases of bad faith, tenants may be entitled to up to twice the amount withheld, as specified in California Civil Code §1950.5(l).
